Tooting Cleaner Terms and Conditions of Service

These Terms and Conditions set out the basis on which Tooting Cleaner provides domestic and commercial cleaning services. By making a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Client means the person, business, company or organisation booking or receiving cleaning services.

Company means Tooting Cleaner, the cleaning services provider.

Services means any cleaning or related services supplied by the Company to the Client, whether on a one-off, regular, or ad hoc basis.

Cleaner means any employee, contractor or representative engaged by the Company to deliver the Services.

Premises means the property or location where the Services are to be provided.

Agreement means the contract between the Client and the Company incorporating these Terms and Conditions.

2. Scope of Services

2.1 The Company provides domestic and commercial cleaning services within its defined service area, which includes Tooting and surrounding locations, as advertised from time to time.

2.2 The specific scope of work for each booking, including areas to be cleaned and any special requirements, will be agreed at the time of booking or in a follow-up confirmation provided by the Company.

2.3 Unless expressly agreed in writing, the Services do not include the following: exterior window cleaning at height, hazardous waste removal, pest control, professional carpet or upholstery cleaning requiring specialist machinery, or any work that may pose a risk to health and safety or requires specialist licensing.

2.4 The Company reserves the right to decline or withdraw Services if the Premises are deemed unsafe, inaccessible, or unsuitable for cleaning.

3. Booking Process

3.1 Bookings may be requested via the Companys accepted communication channels as advertised. The Client must provide accurate details, including the Premises address, type and size of the property, requested date and time, and any specific requirements.

3.2 All bookings are subject to availability and confirmation by the Company. A booking is not considered confirmed until the Company has issued a booking confirmation.

3.3 The Company may request additional information or photographs of the Premises to provide an accurate estimate. Any estimate given is based on the information supplied and may be adjusted if the actual condition of the Premises differs materially.

3.4 The Client is responsible for ensuring that all necessary access arrangements are in place for the agreed time. Failure to provide access may result in a call-out or cancellation fee.

3.5 For ongoing or regular cleaning arrangements, the frequency, day and approximate time of visits will be agreed in advance. The Company reserves the right to reasonably amend the scheduled time and will use reasonable efforts to notify the Client of any changes.

4. Pricing and Payments

4.1 Prices for Services are set out in the Companys pricing information or as communicated to the Client at the time of booking. Prices may be quoted as hourly rates, fixed fees, or package prices.

4.2 All prices are provided on the basis of the information supplied by the Client. The Company reserves the right to amend the price where the work required is significantly different from the description provided at the time of booking.

4.3 The Company will inform the Client of any price adjustment before or during the provision of the Services. If the Client does not agree to the revised price, the Company may cancel the Services and a reasonable cancellation or call-out fee may be applied.

4.4 Payment terms will be confirmed at the time of booking. The Company may require full or partial payment in advance, or may permit payment upon completion, depending on the type of service and the Clients history with the Company.

4.5 The Company accepts payment by methods as specified in its current payment policy. Cash payments, where accepted, must be made directly to the Company or as instructed, and not solely to individual Cleaners.

4.6 Invoices are due for payment on the date specified. If payment is not received by the due date, the Company reserves the right to charge interest on overdue amounts and may suspend or cancel further Services.

4.7 The Client is responsible for any bank charges, transfer fees or similar costs arising from payment.

5. Cancellations, Rescheduling and Access

5.1 The Client may cancel or reschedule a booking by providing the minimum notice period specified by the Company. This notice period will be stated at the time of booking or in the booking confirmation.

5.2 If the Client cancels or reschedules with less notice than required, the Company reserves the right to charge a cancellation fee. This may be up to the full value of the booking, particularly for same-day cancellations or where the Cleaner has already attended the Premises.

5.3 If the Cleaner is unable to gain access to the Premises at the agreed time due to keys not being available, incorrect details, or the Client or representative not being present where this is required, the visit may be treated as a late cancellation and a fee may be charged.

5.4 The Company may cancel or reschedule a booking due to unforeseen circumstances, including staff sickness, severe weather, transport disruption or other events beyond its reasonable control. The Company will use reasonable efforts to notify the Client as soon as possible and offer an alternative appointment.

5.5 In the event of repeated cancellations or access issues by the Client, the Company reserves the right to terminate ongoing arrangements or refuse future bookings.

6. Client Obligations and Premises Preparation

6.1 The Client must ensure that the Premises are safe and suitable for cleaning. This includes, but is not limited to, providing adequate lighting, safe electrical supply, and clear access to areas to be cleaned.

6.2 The Client must inform the Company in advance of any known hazards, delicate items, alarm systems, or restricted areas within the Premises.

6.3 The Client is responsible for securing cash, jewellery, valuables and confidential documents before the Cleaner attends. The Company does not accept responsibility for loss of any items not properly secured.

6.4 The Client must ensure that any pets are safely contained during the visit and do not interfere with the provision of the Services.

6.5 If the Premises are excessively cluttered, unsanitary, or contain hazardous materials, the Cleaner may refuse to carry out part or all of the work and the Company may charge for time spent on site.

7. Cleaning Materials and Equipment

7.1 Unless otherwise agreed, the Company will supply its own standard cleaning products and equipment suitable for general domestic and commercial cleaning.

7.2 If the Client requests the use of specific products, including eco-friendly or specialist items, this must be agreed in advance. The Company may request that the Client provides such products, and the Client is responsible for ensuring they are safe and appropriate for use.

7.3 The Company is not liable for any damage arising from the use of products provided or specified by the Client, where the Cleaner has followed the instructions provided.

8. Waste Handling and Regulations

8.1 The Company will comply with applicable waste and environmental regulations when handling and disposing of waste generated during the provision of the Services.

8.2 Standard household waste generated during cleaning will be placed in the Clients designated bins within the Premises or as otherwise agreed. The Company does not ordinarily remove waste from the Premises unless this has been expressly agreed as part of the Service.

8.3 The Company does not handle or dispose of hazardous, clinical, or controlled waste, including but not limited to medical waste, needles, chemicals, asbestos, or similar materials. If such materials are discovered, the Cleaner may suspend work in the affected area and the Company may terminate the Service for that visit.

8.4 The Client is responsible for ensuring that any special waste is managed in accordance with relevant laws and local regulations, and for instructing appropriate licensed waste carriers where required.

9. Quality of Service and Complaints

9.1 The Company aims to provide Services with reasonable skill and care consistent with industry standards.

9.2 If the Client is dissatisfied with any aspect of the Service, they must notify the Company as soon as reasonably practicable, and in any event within 24 hours of the visit, providing clear details of the issue.

9.3 Where a complaint is justified, the Company may, at its discretion, offer a re-clean of the affected areas or an appropriate partial credit. This will be the Clients sole and exclusive remedy for any claim related to the quality of the Service.

10. Liability and Insurance

10.1 The Company maintains appropriate public liability insurance in respect of its Services.

10.2 The Company will take reasonable care when providing the Services, but shall not be liable for normal wear and tear, pre existing damage, or deterioration resulting from the Clients failure to properly maintain the Premises or items within it.

10.3 The Client must notify the Company in writing of any alleged loss or damage within 24 hours of the Service visit, providing supporting evidence where possible. Failure to do so may limit the Companys ability to investigate and may affect any potential remedy.

10.4 The Companys total liability to the Client arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the total amount paid by the Client for the specific Service during which the event giving rise to the liability occurred.

10.5 The Company shall not be liable for any indirect or consequential loss, loss of profit, loss of business, or loss of opportunity arising from or in connection with the Services.

10.6 Nothing in these Terms and Conditions excludes or limits the Companys liability for death or personal injury caused by its negligence, for fraud, or for any other matter for which liability cannot lawfully be excluded or limited.

11. Keys and Security

11.1 Where the Client provides keys or access codes to the Company, the Company will take reasonable steps to keep them secure and confidential.

11.2 Keys may be labelled with a code or nickname and not with the full address of the Premises.

11.3 The Companys liability for loss or damage arising from lost or misplaced keys shall be limited to the reasonable cost of key replacement. The Company is not responsible for any consequential losses resulting from such loss or misplacement.

12. Staff and Non Solicitation

12.1 The Client agrees not to directly employ, engage, or offer work to any Cleaner introduced by the Company, other than through the Company, during the provision of Services and for a period of six months thereafter.

12.2 If the Client breaches this clause, the Company reserves the right to charge a reasonable introduction fee reflecting the cost of recruitment, training, and loss of revenue.

13. Force Majeure

13.1 The Company shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events, circumstances, or causes beyond its reasonable control. These may include severe weather, transport disruption, accidents, strikes, pandemics, or other similar events.

13.2 In such circumstances, the Company may suspend the Services for the duration of the event or cancel affected bookings without liability, other than to refund any prepayments for Services not delivered.

14. Data Protection and Privacy

14.1 The Company will process personal data provided by the Client in accordance with applicable data protection laws.

14.2 Personal data will be used for the purposes of managing bookings, delivering Services, handling payments, and dealing with queries or complaints.

14.3 The Company will take reasonable steps to protect personal data from unauthorised access or disclosure, and will only share such data with third parties where necessary for the performance of the Agreement or where required by law.

15. Amendments to Terms and Conditions

15.1 The Company may update or amend these Terms and Conditions from time to time. The latest version will apply to all new bookings made after the date of publication of the updated Terms.

15.2 For ongoing or regular Clients, the Company will notify the Client of any material changes where reasonably practicable. Continued use of the Services following such notice will constitute acceptance of the updated Terms and Conditions.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.

17. General Provisions

17.1 If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that right or remedy.

17.3 The Agreement is between the Client and the Company. No other person shall have any rights to enforce any of its terms.

17.4 These Terms and Conditions, together with any written confirmation or service specification provided by the Company, constitute the entire agreement between the parties and supersede all previous discussions, correspondence, or understandings relating to the subject matter.
